ARTICLE 1 : Preamble
The purpose of this document is to define General Conditions of Use ("GCU") of Chorus Pro portal proposed by the AIFE (Agence pour l'Informatique Financière de l'Etat) for state suppliers, local authorities and their public institutions, justice cost providers and farm operators.
The term "supplier" is used below to designate companies and legal persons - in article 1 of Ordinance No. 2014-697 of 26 June 2014 on the development of electronic invoicing- who hold an account on the "Chorus-Pro" portal.
The "Chorus-Pro" portal is a free invoice tracking service.
It also allows the unitary input or the submission of invoices offering a service of dematerialization of theses invoices allowing the establishment, the emission and the archiving of electronic invoices addressed to several State services and local authorities - in accordance with the regulations in force
The Chorus Pro portal offers to suppliers two sets of features:
- Visibility of invoice processing on public institution’s accounting application for all invoices submitted through the Chorus Pro solution.
- Online input or filiing online
ARTICLE 2 : Portal access and availability
The Chorus Pro portal is available at the following website:
https://chorus.pro.gouv.fr
This website is accessible on internet, from any type of terminal integrating the following operating systems: Windows 8 or higher
Mac OS (X 10.3) or higher
Android or Linux
And all types of standard browser (i.e. IE11 and higher, Firefox 17 and higher, Safari 5 and higher, Chrome 23 and higher).
The portal is available 24 hours a day, 7 days a week, subject to occasional maintenance operations, technical incidents or impossibility of operation resulting from a case of force majeure.
An assistance device by email, form or chat is available in case of technical difficulty or question regarding the invoice processing.
ARTICLE 3 : Regulatory compliance
The "Chorus-Pro" service complies with French laws and regulations (Law No. 2014-1 of January 2, 2014) and the Community regulations in force.
ARTICLE 4 : Security
The AIFE institution makes all necessary to ensure the continuity and availability of the service as well as the integrity and confidentiality of the data between Chorus Pro users.
AIFE formally certifies to users the Chorus Pro portal is approved in accordance with the requirements defined by the RGS (General Security Reference System, Ordinance 2005-1516 of 8 December 2005 and Decree 2010-112 of 2 February 2010)
ARTICLE 5 : Authentication
The supplier commits to reserve access to the "Chorus-Pro" portal only to the persons authorized for this purpose and to guarantee the security and confidentiality of all identifiers and passwords it has in order to allow access to the portal.
He agrees to report to AIFE any loss of authentication, any attempt to breach or any anomaly relating to use of his username or password.
The creation of a first account on the portal by a new supplier makes him the main manager on behalf of the company he represents. The main manager is authorized to modify all data referencing the company and to create for the secondary manager or for a simple user an account.
ARTICLE 6 : Responsibilities
The supplier retains full responsibility for its billing obligations and its consequences as far as value added tax (VAT). He remains the only person liable for VAT.
The supplier is responsible of the liability and accuracy of the data sent to AIFE, on its behalf. He undertakes to verify that data do not contain information likely to infringe the rights of a third party or to violate the rules of public order.
The responsibility of the AIFE cannot be engaged for the contents of invoice or their attachments.
The responsibility of the AIFE cannot be engaged in case of fraudulent use of authentication communicated to the supplier.
The responsibility of the AIFE cannot be engaged in case of total or partial unavailability of Chorus Pro when the cause of failure results from telecommunication network and / or connection equipment.
The responsibility of the AIFE cannot be engaged in case of any damages, errors or deficiencies where the breach or improper performance is the result of:
- Fault, negligence, omission or failure from the supplier,
- Late communication of information by the supplier,
- Failure to comply with AIFE recommendations,
- A fault, negligence or omission of a third party over which AIFE has no supervisory power,
- In case of occurrence of a force majeure event.
ARTICLE 7 : Invoice entry with the portal
For invoice input on the portal, AIFE supports the originals of the payment requests, their storage, their transmission to the State, local authorities, public institutions and other prescribing services (including their archiving with probative value).
The supplier acknowledges that the dating process used by the "Chorus Pro" Service is reliable and that the transaction dates performed by the "Chorus Pro" platform are subject of proof between the parties, including in the event of litigation.
The supplier acknowledges that in case of disputes, the electronic invoices entered into Chorus Pro are admissible in court and will show the data and facts they contain.
The supplier accepts the responsibility for all operations carried out on the "Chorus Pro" platform as soon as the company authentication (including login and password) have been activated to make operations.
Invoices inputed on the portal are archived for a period of 10 years on an archiving platform with probative value, in accordance with the recommendations of ANSSI (Agence Nationale de la Sécurité des Systèmes d'Information) and SIAF (Service Interministériel des Archives de France). This platform ensures the acquisition, indexing, timestamping, archiving and consultation of all documents, in accordance with the requirements of the General Directorate of Public Finance. Invoices suppliers archives are accessible for viewing and available for download on the portal, for a period of 10 years, including after supplier’s account deactivation.
ARTICLE 8 : Personal data protection
The AIFE processes personal data of the users (« data subjects » in GDPR meaning) of the portal.
Chorus Pro users are :
- Suppliers
- Public agents, users of the application
- Justice cost providers
- Farm operators
The people concerned have noted that information (personal data listed below) is mandatory to use the portal features. If those information are not communicated, the portal cannot be used. Any false or irregular declaration results from the responsibility of the user.
Personal data
Personal data is defined by data relating to the users of the portal. The following categories of personal data are mainly collected as part of transaction with AIFE:
- Civil status, identity, identification data - ie. surname, first name, postal address, farmers and justice cost provider‘s e-mail, business address, telephone, fax, user e-mail address, voice of users requesting Chorus Pro phone support (registration with user agreement),
- Economic and financial information (Bank account of state providers),
- Connection data (application logs),
- Other: PACAGE number for the functionality of DEMATIC (application on line of refund of the Internal Tax of Consumption by the agricultural professions).
Legal basis
In accordance with the data protection regulations, the AIFE collects the personal data and implements the processing of which the legal basis is based on the consent collected either at the account creation or by the acceptance of these Terms.
Retention duration.
The personal data related to the Chorus Pro users administration agents are deleted as soon as the user deactivates the account himself (the application traces are kept for 18 months).
The personal data related to the invoices are kept 10 years after the invoice validation by the user.
Subcontracting treatments.
The personal data can be communicated by AIFE to other providers (Subcontractant). As such, the subcontractors involved have committed themselves to comply with the European regulations on data protection (as part of their relation with the «Ministry of Action and Public Accounts »). The Ministry of Action and Public Accounts has focused on selecting subcontractors with the necessary guarantees.
Recipients
Data is treated confidentially and is only communicated to the application managers, auditors and external auditors (financial jurisdictions and Ministry auditors, AQ-SSI), delegated to the protection of personal data of the Ministry of Action and Public Accounts, suppliers, farmers (DEMATIC), justice cost providers and invoices recipients (public structures).
They will only be passed on to third parties- outside the categories listed above - if legal or regulatory obligations or judicial decisions are requested.
The Ministry of Action and Public Accounts is not in charge of personal data processing implemented independently of Chorus Pro.
Goals
The Chorus Pro portal, accessible from Internet, is available to the State services, local authorities, public institutions and all their suppliers.
The portal allows to invoice depositors, Justice cost provider or TIC requesters, to create and administer their account on the Chorus pro application, to enter or deposit invoices, justice cost or refund request, as well as to add attachments. It also allows applicants to follow the progress of the processing of their files.
Security of personal data
The Ministry of Action and Public Accounts takes the technical, physical and organizational measures necessary to protect the security of personal data and to prevent the risk of a deformed, damaged or unauthorized third parties have access to it.
Rights of people
« Users » have dedicated rights to their personal data, which meaning:
A right of information, A right of access, A right of rectification, A right of cancellation, A right of limitation. These rights are dedicated rights granted in accordance with Chapter III of the GDPR
The persons concerned are also informed they have a right of objection for legitimate reasons.
These rights can be exercised, once connected to the platform, by electronic mail to the following address: referent-dpd.aife@finances.gouv.fr
